1. Overview

1.1 These Terms of Service ("Terms") govern your use of the OttrCall website, services, and platform, operated by QuasWexExort ("we", "us", or "our").

1.2 By accessing or using our services, you accept and agree to be bound by these Terms. If you do not agree, you may not use the service.

1.3 Continued use of the platform after updates constitutes your agreement to the revised Terms.


2. Services Provided

2.1 OttrCall offers AI-powered outbound calling solutions, including but not limited to:

  • Lead qualification
  • Appointment setting
  • Customer follow-ups
  • Feedback calls

2.2 Calls are made on behalf of clients, based on recipient phone numbers and instructions they provide.

2.3 Our AI agents use:

  • Large Language Models (LLMs) for summarizing and interpreting conversations
  • Text-to-Speech (TTS) for voice generation
  • Speech-to-Text (STT) for transcription

3. Eligibility

3.1 You must be 18 years or older to use our services.

3.2 Our services are intended for business users only.


4. Account Use

4.1 You are responsible for maintaining the confidentiality of your login credentials.

4.2 You agree to use the platform only for lawful business purposes.


5. Billing and Payments

Note: This Terms of Service is part of our Paddle onboarding process and may be updated following their verification.

5.1 Paddle as Payment Provider

All payments will be processed by Paddle (https://www.paddle.com), our intended Merchant of Record and payment provider. Paddle will handle invoicing, taxation, and recurring billing on our behalf once integration is finalized.

5.2 Cancellation

You may cancel your subscription at any time through your account dashboard. Your access will continue until the end of your billing cycle.

5.3 Refunds and Pro-Rata

We do not offer any pro-rated billing or credits, even if our payment provider supports such functionality. Charges apply per full billing cycle based on your selected plan.

5.4 Reference to Paddle Terms

Please refer to Paddle’s Buyer Terms for more information on purchase conditions and billing jurisdiction once your payments are processed through Paddle.


6. Refund Policy

All sales are final. We do not offer refunds for:

  • Partial usage
  • Early cancellation
  • Unused subscription time

Our product incurs infrastructure costs as soon as AI services are triggered (LLM, TTS, STT). These costs are non-refundable to us as well.

You are free to cancel at any time. There is no lock-in period.

UK/EU Customers: You waive your 14-day right of withdrawal in accordance with Paddle’s Buyer Terms when you opt-in at checkout.


7. Data Usage & Privacy

You retain ownership of any data you upload or instruct us to use.

We collect lead data only when a visitor submits a Book a Demo form, and treat that as consent to reach out.

Data collected via phone calls is used strictly to fulfill the service - we do not sell or use it for training or marketing.

Transcripts, summaries, and metadata are stored securely on Supabase servers and may be deleted at your request.

8. AI Infrastructure & Dependency

Our platform depends on third-party services for AI processing, such as LLMs, TTS, and STT systems. These services are subject to:

  • Pricing changes without prior notice
  • Temporary outages or degraded performance
  • Usage caps or regional restrictions

You acknowledge that:

  • Our pricing may change in response to underlying infrastructure shifts
  • We are not liable for outages caused by these providers

9. Acceptable Use

You may not use the service to:

  • Harass individuals or engage in abusive behavior
  • Promote illegal activity or misinformation
  • Represent your affiliation falsely

Violation of this clause may result in immediate termination.


10. Intellectual Property

The OttrCall platform, content, and branding are owned by QuasWexExort.

You may not copy, reverse-engineer, or distribute any portion of the platform without permission.


11. No Warranties

Our service is provided "as is." We do not warrant:

  • Uptime guarantees
  • Accuracy of transcription or lead classification
  • Compatibility with all CRM or business workflows

12. Limitation of Liability

Our total liability is limited to the amount you paid in the 30 days prior to any claim.

We are not liable for indirect, incidental, or consequential damages.


13. Force Majeure

We are not liable for failure to perform due to reasons beyond our control, including:

  • Natural disasters
  • Internet or infrastructure failure
  • Legal or regulatory actions
  • Civil unrest, pandemic, or war
  • Vendor shutdowns

14. Changes to Terms & Pricing

We may revise these Terms at any time. Material changes will be notified via email or posted on our website.

Continued use of our service constitutes your acceptance of the updated Terms.


15. Governing Law

These Terms are governed by the laws of India.

Disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
